DECREE NO. 2012/381 OF 14 SEPTEMBER 2012 CONCERNING THE ORGANIZATION OF THE MINISTRY OF ARTS AND CULTURE

The President of the Republic, Having regard to the Constitution; Having regard to Decree No. 2001/408 of 9 December 2011 concerning the organization of Government,

Decrees :

TITLE I :  GENERAL PROVISIONS

Article 1.- ( 1 )  The Ministry of Arts and Culture is placed under the authority of

 a Minister.

(2)  The Minister of Arts and Culture is responsible for the development and implementation of the Government’s policy on the promotion and development of arts and culture. In this capacity, he is responsible for:- the development and dissemination of national arts and culture;- the preservation of historical sites and monuments;- the protection, conservation, enrichment and promotion of cultural, artistic and cinematographic heritage;- the promotion of artistic and cultural creation;- the promotion and monitoring of the distribution of works of art and cinematographic works, in relation to the administrations concerned;- museums, libraries, film libraries, media libraries and national archives;- conservatories and other vocational training centers in the relevant trades;- monitoring the activities of the national ballet, the national orchestra, the national theatre;- the promotion of cinematography and dramatic arts;- the promotion and professional development of artists;- the promotion and supervision of major cultural events;- monitoring the activities of national collective management structures for copyright and related rights.

(3)  He ensures liaison between the Government and international organisations working in the fields of art and culture, in particular the United Nations Educational, Scientific and Cultural Organization (UNESCO), the African Intellectual Property Organization (OAPI) and the World Intellectual Property Organization (WIPO), in relation with the Ministry of External Relations and other relevant administrations.

(4 )  It also ensures liaison between public authorities and collective management bodies for copyright and related rights.

(5)  He exercises guardianship over the Palais des Congrès.

Article 2. – For the accomplishment of its missions, the Minister of Arts and of Culture has: a Private Secretariat;- two (02) Technical Advisors; a General Inspectorate; a Central Administration; Decentralized Services; Related Services. TITLE II: OF THE PRIVATE SECRETARIAT Article 3. – Placed under the authority of a Head of Private Secretariat, the Secretariat Particulier is in charge of the Minister’s confidential affairs.TITLE III: TECHNICAL ADVISORS Article 4.- The Technical Advisors shall carry out all missions entrusted to them by the Minister. TITLE IV: FROM THE GENERAL INSPECTORATEArticle 5.- (1) Placed under the authority of an Inspector General, the Inspectorate Generalis loaded:- evaluation of the performance of services in relation to the objectives set, in conjunction with the General Secretariat;- internal control and evaluation of the functioning of the services ofMinistry, its affiliated structures, and related organizations;- information from the Minister on the quality of the operation and performance of the services;- the evaluation of the application of organizational techniques and methods as well as the simplification of administrative work, in conjunction with the departments responsible for administrative reform;- the implementation of the anti-corruption strategy within theMinistry, in conjunction with the ministerial unit for combating corruption.(2) It includes, in addition to the Inspector General, two (02) Inspectors. Article 6.- (1) In carrying out control and evaluation missions, the Inspector General and the Inspectors have access to all documents of the services being controlled.In this capacity, they can:- requesting information, explanations or documents from the heads of the services being audited, who are required to respond within the given time limits;- to have, on an ad hoc basis, the necessary staff from other departments of theMinistry;- to request, if necessary and after approval from the Minister and in accordance with the law, the public force to assist them in investigating offenses against public funds.(2) Each inspection or audit mission shall result in the preparation of a report addressed to the Minister, with a copy to the Secretary-General. The Minister shall send a copy of the report to the Ministers responsible respectively for administrative reform and supreme audit.(3) The Minister shall send quarterly a control report and the annual activity report of the Inspectorate General to the Prime Minister, Head of Government. TITLE V: FROM THE CENTRAL ADMINISTRATION Article 7. The Central Administration comprises:- the General Secretariat;- the Directorate of Cultural Heritage;- the Directorate for the Development and Promotion of the Arts;- the Directorate of Archives and Administrative Documents;- the Directorate of Books and Reading;- the Directorate of Cinematography and Audiovisual Productions;- the Directorate of Entertainment and Creative Industries;- the General Affairs Department. CHAPTER I: FROM THE GENERAL SECRETARIAT Article 8.- (1) The General Secretariat is placed under the authority of a Secretary General, principal collaborator of the Minister who follows the instructions on the affairs of the Department and receives from the Minister the necessary delegations of signature.(2) In this capacity he:- coordinates the action of the Central Administration and the decentralized services of the Ministry and holds coordination meetings for this purpose, the minutes of which he sends to the Minister;- defines and codifies the internal procedures of the Ministry;- ensures the ongoing training of staff and organizes, under the authority of the Minister, seminars and refresher courses for improvement or specialization;- follows, where appropriate, the actions of the attached services, whose action program it approves and whose activity reports it receives;- ensures the speed of processing files, centralizes archives and manages the Ministry’s documentation.(3) In the event of the absence or incapacity of the Secretary-General, the Minister shall appoint a Director to serve as interim. Article 9. The following are attached to the General Secretariat:- the Legal Affairs Division;- the Studies, Planning and Cooperation Unit;- the Monitoring Unit;- the Communication Unit;- the Information Technology and Statistics Unit;- the Translation Unit;- the Sub-Directorate for Reception, Mail and Liaison;- the Documentation and Archives Service.


Section I: From the Legal Affairs Division Article 10.- (1) Placed under the authority of a Division Chief, the Division of Legal Affairs is responsible for:

– the preparation and formatting of draft legislative or regulatory texts initiated by the Ministry or submitted for the Minister’s signature;- legal opinions on matters falling within the Ministry’s remit;- respect for the legality and legal regularity of acts binding theMinistry;- the processing of appeals against acts produced by theMinistry, in conjunction with the relevant operational structures;- defending the interests of the State in court whenever the Ministry is involved in a case;- monitoring the execution of court decisions involving the Ministry;- the promotion and popularization of legal culture within theMinistry.(2) It includes:- the Studies and Regulations Unit;- the Litigation Unit.Article 11.- (1) Placed under the authority of a Head of Unit, the Studies Unit and the Regulatory Authority is responsible for:


– the preparation and formatting of all draft legislative or regulatory texts initiated by the Ministry or submitted for the Minister’s signature;- legal advice on important issues within the Ministry’s purview;- the codification of legislative and regulatory texts.(2) It includes, in addition to the Head of Cell, two (02) Assistant Research Officers. Article 12.- (1) Placed under the authority of a Cell Head, the Cell ofLitigation is handled by:- the processing of appeals against acts produced by theMinistry, in conjunction with the relevant operational structures;- defending the interests of the State in court whenever the Ministry is involved in a case;- monitoring the execution of court decisions involving the Ministry;(2) It includes, in addition to the Head of Cell, two (02) Assistant Research Officers.Section II: From the Studies, Planning and Research Unit Cooperation Article 13. – Placed under the authority of a Head of Unit, the Studies, Planning and Cooperation Unit is responsible for:- studies and research development in the fields of art and culture;- the development and evaluation of the artistic and cultural policy of theGovernment;- programming of participation in international cultural activities and events;- the creation of the cultural map and calendar;- bilateral and multilateral cooperation;- programming of participation in international cultural activities and events;- monitoring the activities and programs of international cultural institutions;- monitoring, under the authority of the Minister, of the Ministry’s participation in international organizations and in the negotiations of international agreements and conventions relating to the fields of arts and culture;- seeking external support for the financing of arts and culture development programs and projects.(2) It includes, in addition to the Head of Cell, two (02) Assistant Research Officers. Section III: The Monitoring Unit Article 14.- (1) Under the authority of a Head of Unit, the Monitoring Unit shall carry out any study or mission assigned to it by the Secretary-General. Its responsibilities include, in particular:- monitoring the activities of the central and decentralized services of the Ministry;- from the synthesis of action programs, economic outlook notes and the use of activity reports transmitted by the central and decentralized services of the Ministry.(2) It includes, in addition to the Head of Cell, two (02) Assistant Research Officers. Section IV: From the Communications Unit


Article 15.- (1) Placed under the authority of a Cell Head, the Cell ofCommunication is in charge:- the implementation of the government communication strategy within the Ministry;- the design and formatting of specific messages from the Minister;- the collection, analysis and preservation of journalistic and audiovisual documentation of the Ministry;- from the exploitation of articles relating to matters within the Ministry’s purview published in the national or international press;- the ongoing promotion of the Ministry’s brand image;- the protocol and organization of the ceremonies in which theMinister, in liaison with the cabinet;- production in the media, specialized programs of the Ministry;- the organization of press conferences and other communication activities of the Minister;- the drafting and publication of the newsletter and all other publications of interest to the Ministry.(2) It includes, in addition to the Head of Cell, two (02) Assistant Research Officers.Section V:From the Information Technology and Statistics UnitArticle 16.- (1) Placed under the authority of a Head of Unit, the Information Technology and Statistics Unit is responsible for:- the design and implementation of the IT master plan ofMinistry;- studies for the development, operation and maintenance of the Ministry’s computer applications and network;- the establishment of banks and databases relating to the various IT subsystems of the Ministry;- centralisation and dissemination of statistical data relating to the activities of the Ministry;- the security, availability and integrity of the computer system;- the computer processing, storage and dissemination of data;- technological monitoring in the field of information technology;- the promotion of information and communication technologies within the Ministry.(2) It includes, in addition to the Head of Cell, two (02) Assistant Research Officers.Section VI:From the Translation UnitArticle 17.- (1) Placed under the authority of a Head of Unit, the Translation Unit is responsible for:- of the current translation of documents;- quality control of current translation;- the creation of a terminological database relating to arts and culture.(2) It includes, in addition to the Head of Unit, two (02) Assistant Research Officers, respectively responsible for translation into French and translation into English.Section VII:From the Sub-Directorate of Reception, Mail andConnectionArticle 18.- (1) Placed under the authority of a Deputy Director, the Sub-Directorate for Reception, Mail and Liaison is responsible for:- of the reception, information and guidance of users of the Ministry;- the receipt, processing and distribution of mail;- the classification and preservation of signed documents;- the reproduction and notification of individual acts and the distribution of regulatory acts as well as all other service documents;- the reactivation of services and other ministerial departments for the processing of files.(2) It includes:- the Reception and Guidance Service;- the Mail and Liaison Service;- the Recovery Service.


Article 19.- (1) Placed under the authority of a Head of Service, the Reception Service and the Orientation Department is responsible for:


– from the receipt of files;- of receiving requests;- welcoming and informing users;- compliance checks of files.(2) It includes:- the Reception and Information Office;- the Compliance Control Office.Article 20.- (1) Placed under the authority of a Head of Service, the Mail Service and Liaison is responsible for:- mail distribution;- the classification and preservation of signed documents;- the reproduction of individual acts and all other service documents;- notification of signed documents;- the creation of virtual folders.(2) It includes:- the “Incoming” Mail Office;- the “Outgoing” Mail Office;- the Reprographics Office.Article 21. – Placed under the authority of a Head of Service, the Recovery Service is responsible for:


– recording user requests;- automatic reactivation of services in case of non-compliance with the standard processing deadlines for files;- the initiative to revive other ministerial departments.Section VIII:From the Documentation and Archives Service


Article 22.- (1) Placed under the authority of a Head of Service, the Documentation and Archives Service is responsible for:


– the design and implementation of the Ministry’s policy regarding the organization of archives;- the collection and dissemination of written, photographic, digital and audiovisual documentation relating to art and culture;

– the design and implementation of a system for classifying administrative documentation, in conjunction with other departments of the Ministry;- the promotion of documentary research in artistic and cultural matters;- the collection, centralization, preservation and dissemination of the Ministry’s documents and archives;- the reproduction and distribution of service documents.(2) It includes:- the Documentation Office;- the Archives Office.CHAPTER II:FROM THE DIRECTORATE OF CULTURAL HERITAGE Article 23.- (1) Placed under the authority of a Director, the Heritage Directorate Cultural is in charge:


– the development and implementation of the Government’s policy on the promotion and protection of archaeological and museographic cultural heritage;- the development and monitoring of the implementation of cultural heritage law;- the protection and preservation of historical sites, places and monuments;- commemoration of historical figures, in conjunction with the relevant administrations;- of the general inventory of tangible and intangible cultural heritage;- the study, conservation and promotion of tangible and intangible cultural heritage;- monitoring and implementation, in conjunction with the Unit in charge of cooperation, of international cooperation in the areas of protection, conservation and promotion of cultural heritage;- the promotion of cultural diversity, in conjunction with relevant government departments.(2) It includes:- the Sub-Directorate of Tangible Cultural Heritage;- the Sub-Directorate of Intangible Cultural Heritage;- the Sub-Directorate for Cultural Diversity.Section I:From the Sub-Directorate of Tangible Cultural Heritage


Article 24.- (1) Placed under the authority of a Deputy Director, the Sub-Directorate of Tangible Cultural Heritage is responsible for:


– the inventory, protection, conservation and enhancement of movable and immovable heritage of historical, artistic or scientific interest, in conjunction with the relevant administrations;- the classification of cultural property;- restoration and monitoring of the management of movable and immovable cultural heritage, in conjunction with the relevant administrations;- control of the movement of works of art and cultural heritage goods within the national territory and abroad, in conjunction with the relevant administrations;- the establishment of the map of historical sites and monuments.(2) It includes:- the Real Estate Cultural Heritage Service;- the Museums Service;- the Archaeology Service.


Article 25.- Placed under the authority of a Head of Service, the Heritage Service Culturel Immobilier is in charge of:- monitoring the inventory, protection, conservation and enhancement of movable and immovable heritage, in conjunction with the relevant administrations;- monitoring the restoration and management of movable and immovable cultural heritage, in conjunction with the relevant administrations;- monitoring of procedures for classifying cultural property;

– the development and monitoring of the map and file of historical sites and monuments.

Article 26. – Placed under the authority of a Head of Service, the Museums Service is charged with:

– monitoring the Government’s policy regarding museum heritage;- the preparation and monitoring of the application of the legislative and regulatory framework in the field of museum heritage;- the definition of technical standards applicable to museums;- the enrichment of public collections;- studies and development of research in the field of museum heritage;- monitoring the management of the National Museum;- monitoring international cooperation in all areas concerning museum activities;- the development of training in museology;- support for the conservation and promotion of community collections;- support for the creation of museums.Article 27.- Placed under the authority of a Head of Service, the Archaeology Serviceis in charge:

– the development and monitoring of the implementation of the national program for archaeological research, in conjunction with the relevant administrations and organizations;- monitoring the protection, conservation and enhancement of archaeological heritage;- monitoring of methodological guidelines and methods of scientific control in archaeology;- the development of the national archaeological map;- participation in the preparation and updating of legislative and regulatory texts relating to archaeological heritage;

– monitoring the application and legislation relating to the protection of archaeological heritage;- monitoring the application of legal and regulatory provisions relating to excavations and research.Section II: From the Sub-Directorate of Intangible Cultural Heritage Article 28.- (1) Placed under the authority of a Deputy Director, the Sub-Directorate ofIntangible Cultural Heritage is responsible for:


– the collection, centralization and exploitation of information relating to customs, practices, knowledge, rites and oral traditions, heritage dances and music, in their historical and socio-anthropological aspects;- inventory and monitoring of the implementation of actions to enhance intangible heritage;- from the repertoire of heritage music and dances;- the study and promotion of historical figures and places;- monitoring the celebration of commemorative holidays.(2) It includes:- the Living and Anthropological Heritage Service;- the Historical Figures and Commemorative Festivals Service. Article 29.- Placed under the authority of a Head of Service, the Living and Anthropological Heritage Service is responsible for:


– monitoring the collection, centralization and use of information relating to customs, practices, knowledge, rites, and oral traditions, heritage dances and music, in their historical and socio-anthropological aspects;- monitoring the inventory and implementation of actions to enhance the value of intangible heritage;- the development of the central repertoire of heritage dances and music.


Article 30. – Placed under the authority of a Head of Service, the Figures Service Historical and Commemorative Events is in charge:- the study and promotion of historical figures and places;- monitoring of national commemorative holiday celebrations.Section III: From the Sub-Directorate of Cultural DiversityArticle 31.- (1) Placed under the authority of a Deputy Director, the Sub-Directorate of theCultural Diversity is responsible for:- the promotion of national artistic and cultural expressions;- the promotion of mother tongues and national languages, in conjunction with the relevant organizations and administrations;- the inventory of national languages, with a view to their preservation as a vehicle of cultural heritage, in conjunction with the administrations and bodies concerned;- the promotion of cultural values;- the training of documentation in the field of heritage.(2) It includes:- the Native and National Languages ​​Service;- the Service for Cultural Expressions and Values.Article 32. – The Language Service, placed under the authority of a Head of Service, Maternelles et Nationales, is in charge of:- the promotion of mother tongues and national languages;- the inventory of languages, with a view to their preservation as a vehicle of cultural heritage, in conjunction with the administrations and organizations concerned; the central directory of mother tongues and national languages.Article 33. – Under the authority of a Head of Service, the Service for Cultural Expressions and Values ​​is responsible for:- the promotion of cultural principles and values;- the promotion of national artistic and cultural expressions;- the constitution of documentary resources for the heritage of cultural expressions and values.CHAPTER II: FROM THE DEPARTMENT OF ARTS DEVELOPMENT AND PROMOTIONArticle 34.- (1) Placed under the authority of a Director, the Directorate ofThe Department for the Development and Promotion of the Arts is responsible for:- the development and implementation of the Government’s policy on the development and promotion of the arts, in conjunction with the relevant administrations;- the development and promotion of creation and production in the fields of performing, visual and applied arts;- the organization and supervision of the dissemination of works in the field of performing, visual and applied arts,- the promotion of all forms of expression and dissemination of the performing arts, in conjunction with the relevant administrations;- the definition of training programs in the fields of performing, visual and applied arts, in conjunction with the National Institute of Arts and Culture;- studies on public artistic practices in the fields of visual and performing arts and specific arts.(2) It includes:- the Sub-Directorate of Performing Arts;- the Sub-Directorate of Visual and Applied Arts.Section I:From the Sub-Directorate of Performing ArtsArticle 35.- (1) Placed under the authority of a Deputy Director, the Sub-Directorate ofArts Vivants is in charge of:- the implementation of government policy in the fields of operatic, choreographic, dramatic, and literary arts;- the organization and supervision of the distribution of works in the relevant fields;- the development and promotion of the creation of the definition of training programs in the relevant arts fields, in conjunction with the National Institute of Arts and Culture;- the creation and updating of the national cultural map;- studies on public artistic practices in the relevant art fields.(2) It includes:- the Department of Lyric and Choreographic Arts;- the Department of Dramatic and Literary Arts.Article 36. – Placed under the authority of a Head of Service, the Lyric Arts Serviceand Choreographics is in charge:- monitoring the implementation of Government policy, in particular in the fields of classical and contemporary music, choral and epic singing, traditional and contemporary dances;- supervision and support for the production of works and shows in the relevant fields;- the development and monitoring of the national cultural activities program;- contributing to the creation of the national cultural map;- the development and updating of the file of professionals, venues and events of the lyric arts;- supporting the activities of institutions and venues for the dissemination of professional shows;- the study and implementation of training policies in the field of operatic arts.Article 37. – Placed under the authority of a Head of Service, the Arts ServiceDramatics and Literature is in charge:- monitoring the implementation of Government policy, in particular, in the fields of theatre, epic storytelling, poetry, novels and essays;- supervision and support for the production of works and shows in the relevant artistic fields;- the development and monitoring of the national cultural activities program;- contributing to the creation of the national cultural map;- the development and updating of the file of professionals, venues and events of dramatic and literary arts;- monitoring the implementation of training policies in the relevant arts fields.Section II:From the Sub-Directorate of Visual and Applied ArtsArticle 38.- (1) Placed under the authority of a Deputy Director, the Sub-Directorate ofVisual and Applied Arts is in charge of:- the implementation of government policy in the fields of visual, applied and multimedia arts;- the organization and supervision of the dissemination of works in the relevant artistic fields;- the development and implementation of the Government’s policy regarding the development and promotion of creation in the aforementioned arts fields;- the development and promotion of creation in the relevant artistic fields;- the definition of training programs in the relevant arts fields, in conjunction with the National Institute of Arts and Culture;- studies on the artistic practices of audiences in the relevant art fields.(2) It includes:- the Visual Arts Department;- the Applied Arts Department;- the Multimedia Arts Department.Article 39. – Placed under the authority of a Head of Service, the Arts ServicePlastics is loaded:- monitoring the implementation of government policy in the fields of painting, sculpture, ceramics and art photography;- the study and implementation of training and professional integration policies for artists, in conjunction with the relevant administrations;- participation in the development and implementation of regulations relating to initial, specialized and continuing training in the field of visual arts;- maintaining the file of professionals in the visual arts sector.Article 40. – Placed under the authority of a Head of Service, the Arts ServiceApplied is loaded:- monitoring the implementation of Government policy, particularly in the areas of arts and crafts, in conjunction with the relevant administrations;- the implementation of Government policy in the fields of fashion, haute couture, hairdressing and culinary arts;- guidance and support for the creation of works and productions in the relevant artistic fields;- the development and monitoring of the cultural activities program;- the supervision and promotion of amateur practices;- contributing to the creation of the cultural map in the field of specific arts;- monitoring the implementation of training policies in the relevant arts fields.Article 41. – Placed under the authority of a Head of Service, the Arts ServiceMultimedia is loaded:- monitoring the implementation of Government policy, particularly in the fields of digital arts, graphic arts and design;- supervision and support for the creation of works and productions in the aforementioned fields;- the development and monitoring of the cultural activities program;- the supervision and promotion of amateur practices;- the creation of the cultural map in the field of multimedia arts;- monitoring the implementation of training policies in the field of multimedia arts.CHAPTER IV:FROM THE DIRECTORATE OF ARCHIVES AND ADMINISTRATIVE DOCUMENTSArticle 42.- (1) Placed under the authority of a Director, the Directorate of Archives and Administrative Documents is responsible for:- the development of the Government’s policy on archives and administrative documents, particularly with regard to collection, processing, classification, preservation and communication;- the development and implementation of uniform scientific and technical standards for the management of administrative documents and archives, in conjunction with the relevant administrations;- the preparation and application of the legislative and regulatory framework relating to archives and administrative documents;- the harmonization of public and private archive management practices, in conjunction with the National Archives;- monitoring and control of the activities of structures that produce the archives;- monitoring the activities of the National Archives and the archive centers of decentralized territorial authorities;- monitoring the processing, communication and promotion of public archives;- the dissemination and promotion of the national archival heritage;- the issuance of visas for curricula and the evaluation of the content of vocational training courses in the relevant fields;- continuing education for professionals in the management of administrative documents and archives;- monitoring the activities of associations and professional groups operating in the sector.(2) It includes:- the Sub-Directorate for Standards, Regulations and Archival Control;- the Professional Development Unit.Section I:From the Sub-Directorate of Standards, Regulations and Archival ControlArticle 43.- (1) Placed under the authority of a Deputy Director, the Sub-Directorate ofStandards, Regulations and Archival Control is responsible for:- the development of the Government’s policy on the management of administrative documents and archives;- the development and implementation of uniform scientific and technical standards in archival matters, in conjunction with the relevant administrations;- participation in the preparation of the legislative and regulatory framework for archives management;- monitoring and control of the activities of structures that produce the archives.(2) It includes:- the Standardization and Archival Regulation Service;- the Archival Technology Service;- the Archival Control Service.Article 44. – Placed under the authority of a Head of Service, the Service of theStandardization and Archival Regulations is responsible for:- participation in the preparation of legislative and regulatory texts on archives;- the development of rules and standards for the management, evaluation and collection of public and private archives;- the development and implementation of a deconcentration and decentralization plan for archives;- the definition and implementation of professional standards for archival science.Article 45. – Placed under the authority of a Head of Service, the Technology ServiceArchivists is in charge of:- monitoring the implementation of the Government’s policy on archival technologies, particularly with regard to digitization, photo-documentation, document reproduction, restoration and sigillography;- monitoring and advising public administrations and archive services on innovation and technological monitoring in the management of archives and administrative documents;- monitoring the implementation of the national policy regarding the development of archive buildings and premises.Article 46.- Placed under the authority of a Head of Service, the Monitoring andArchival Control is responsible for:- monitoring and control of the activities of the National Archives, of archive centers in decentralized territorial communities;- technical advice from public and private administrations, where appropriate, regarding archives;- compliance with standards, legislation and regulations regarding the collection, sorting, classification, description and communication of public and private archives;- the evaluation of the tools for managing the archives of public and private institutions.Section II:From the Professional Development UnitArticle 47.- (1) Placed under the authority of a Cell Head, the Cell ofProfessional Development is responsible for:- continuing education for archive professionals;- the issuing of visas for curricula and the evaluation of content
